Q: What is a PIE and is this product registered as a PIE?

A: A PIE is a Portfolio Investment Entity. Under recent changes to New Zealand legislation a managed fund may register to be a Portfolio Investment Entity which means investment income within the managed fund is subject to different rules relating to tax. These products are currently registered as PIEs. Among these rules capital gains on all New Zealand and some Australian shares incur no tax while other income is subject to tax calculated on the basis of each investor’s Prescribed Investment Rate (PIR).

Q: What is my PIR and why is it important?

A: A PIR is the tax rate used to calculate tax on taxable income. Each investor, whether an individual, company, trustee, registered charity or superannuation fund, has a PIR. For an individual your PIR is based on your taxable income and other income received from investing in PIEs over the last two years and is either 19.5% or 30% (from 1 April 2008). You must supply your PIR at the time of investment and advise of any change thereafter.

  • I am an individual investor, how do I determine my PIR?

If you are a New Zealand resident investor and in either of the last two years your taxable income was $38,000 or less and this income when combined with allotted income or loss from all investments in all your PIE investments was $60,000 or less your PIR is 19.5%. Otherwise it is 30% (from 1 April 2008).

  • I am a joint investor, what PIR will apply?

The PIR of the joint investor with the highest individual PIR will apply to an investment in this product held in joint names.

  • I am a trustee of a family trust, what PIR will apply?

An investment on behalf of beneficiaries of a Trust will be subject to a PIR nominated by the trustees of either 0% or 30% (from 1 April 2008) that best suits the beneficiaries. In nominating the appropriate PIR the trustees may need to seek independent tax advice.

  • My investment is by way of a company, superannuation fund, society or another PIE what PIR will apply?
